Pest Blockers provides pest control services to residential and commercial customers. These terms and conditions (the “Terms”) govern the provision of services by the Company to you (the “Customer”).
Acceptance of Terms
By requesting services from the Company, you agree to be bound by these Terms. If you do not agree to these Terms, you may not request services from the Company.
Services
The Company will provide pest control services to you in accordance with the scope of work agreed upon in writing between the Company and the Customer. The Company will use its best efforts to provide the services in a timely and professional manner.
Payment
The Customer will pay the Company for the services in accordance with the rates set forth in the scope of work. The Customer is responsible for all taxes and other government fees associated with the services.
Warranty
The Company warrants that the services will be performed in a workmanlike manner and that the Company will use its best efforts to achieve the results specified in the scope of work. The Company does not warrant that the services will be successful in eliminating all pests from the Customer’s property.
Limitation of Liability
The Company’s liability for any damages arising out of or in connection with the services is limited to the amount of the fees paid by the Customer for the services. The Company is not liable for any indirect, consequential, or incidental damages, including but not limited to lost profits, loss of business, or damage to property.
Dispute Resolution
Any dispute arising out of or in connection with these Terms will be resolved by binding arbitration in accordance with the rules of the Australian Commercial Arbitration Centre. The arbitration will be held in Sydney, Australia. The decision of the arbitrator will be final and binding on the parties.
Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision will be struck from these Terms and the remaining provisions will remain in full force and effect.
Entire Agreement
These Terms constitute the entire agreement between the Company and the Customer with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
Changes to Terms
The Company may modify these Terms at any time by posting the modified Terms on its website. The modified Terms will be effective immediately upon posting.
Governing Law
These Terms will be governed by and construed in accordance with the laws of the State of New South Wales, Australia.
